International Transboundary Movements of Waste Policy Adjustment and Response Measures Analysis Project

The objectives of this project include: (1) to research and analyze the management policies of waste transboundary movements of the Basel Convention and neighboring countries, and provide corresponding suggestions for domestic management and utilization on waste of international management consensus; (2) to examine waste import and export management with views of resource circulation, and develop border management suggestions that are beneficial to the construction of domestic resource circulation; (3) to maintain the operation of Taiwan’s Action to the Basel Convention Website, and assist in reviewing applications for permission to export hazardous industrial waste to improve quality and efficiency. The implementation results of this project are as follows: (1) Important issues that had been discussed in the fifteenth meeting of the Conference of the Parties (COP15) to the Basel Convention were compiled and analyzed. The COP15 decision includes improving controls over the transboundary movements of E-wastes, and guidance on transit transboundary movements as well as guidance on insurance, bond and guarantee. On the other hand, the EU proposal for revised waste shipment regulations will differentiate the management measures on whether the recipient country is an OECD member and introduce stricter penalties against illegal shipments. (2) Compilation of waste import and export measure among countries including Japan, South Korea, China, Vietnam and Malaysia has been completed. They implement import and export controls over waste of international management consensus; however, such waste may be imported only when it meets resource recycling standards or a deposit has been paid. (3) 32 types of waste of concern have been filtered out based on the 10 key materials advised by the SMM Web, 15 types of industrial waste required as raw materials, and wastes that are commonly permitted to be imported and exported. Those 32 types of waste can correspond to 61 C.C.C. Codes. Also, this project developed mechanism to monitor abnormalities in the import volume of raw materials based on an industrial damage early warning model made by the Ministry of Economic Affairs, and completed the research and analysis of the early warning and evaluation mechanism for waste of concern from January to November in 2022. (4) Suggestions for revising Article 38 of the Waste Disposal Act as well as other relative regulations have been proposed in correspondence to the resource circulation policy and important issues concerning the import and export of waste, including the following: the adjustment of agencies that accept and review the application for permission to import and export, the permission management for wastes required as raw materials, the addition of requirements for reviewing resource circulation, the persons responsible for the return shipments of waste and relevant procedures. (5) Taiwan’s Action to the Basel Convention Website has met the accessibility conformance levels on March 15th, 2022. So far, the total number of website visitors has reached 269,000. This project continued to update and maintain the Website, and carried out the information security inspections on a regular basis. In addition, this project has assisted in reviewing 27 applications for permission to export hazardous waste. (6) This project held three expert consultation meeting with a total of 24 experts had attended: “Improvement on the management of wastes required as raw materials” on July 1st, 2022, “Feasibility on the simplification of waste import and export permission procedure” on July 5th, 2022, and “Application of early warning and evaluation mechanism on the import and export of waste” on November 7th, 2022. (7) Three sessions workshops for promoting the waste import and export regulations have been held respectively on September 13th, 20th, and 27th with a total of 140 attendees.
